Dear Sir or Madam,

I write to give final notice of intent to appeal the presumed denial of the FOIA request #45289 submitted on July 11, 2016, which was received at your office on July 14.

On August 23, 2016, over two months ago, you wrote to inform that queries to NIH offices were sent out three months ago on July 28, 2016 [1], that the "request appears to be adequate for processing," [2] and that you are "continuing to work on [my] case, and will have a response to [me] soon." [3] No response has been received. The nature of the request is such that there is no fathomable reason it might be denied under any of the exemptions to FOIA, nor has any indication of backlog or other reason been given.

Please be advised that in the event there is no reply responsive to the request for informtion by Tuesday, November 15, 2016 that the request will be presumed to have been denied, and an appeal will be filed with the Department of Health and Human Services.
