Dear Sir or Madam,

I write to give notice of intent to appeal the presumed denial of of the FOIA request (copy enclosed) submitted on July 11, 2016, which was received at your office on July 14 (receipt enclosed).

As a response was due within 20 working days of receipt, and the request was received on July 14, NIH should have responded by August 11, 2016. No response has been received. The nature of the request is such that there is no fathomable reason it might be denied under any of the exemptions to FOIA, nor has any indication of backlog or other reason been given.

Please be advised that in the event no response of some sort is received by Tuesday, September 6, 2016 that the request will be presumed to have been denied, and an appeal will be filed with the Department of Health and Human Services. I also ask again here for all the information sent in my status inquiry of July 25, 2016 (copy and receipt enclosed).
